1. Parties and Subject Matter of the Agreement
This agreement covers the terms under which the transportation of our guests (hereinafter referred to as the “Passenger/Customer”) from the addresses specified by them to airports, or vice versa, before or after a flight, shall be provided by Ege VIP Tur (the “Agency”) in consideration of a specified fee.
2. Service Fee, Additional Charges and Payment Terms
- Pricing: Unless otherwise stated, the contractual fees indicated on our website or through our communication channels do not include VAT.
- Additional Stop Requests: During the private transfer service, requests for visits to or stops at locations other than the pre-determined route shall be free of charge only if they remain on the main route and do not require waiting. For each different location outside the route, an additional fee of 250 TL shall be paid by the passenger.
- Baby Seat: If requested at the time of reservation, one baby seat shall be placed in the allocated vehicle for an additional fee of 250 TL.
- Payment Methods: Bank Transfer/EFT, Credit Card (Virtual POS/Mail Order), Cash in Vehicle, or Advance Payment options are available.
- Invoice Issuance: Invoices for the purchased service shall be issued and delivered to the customer within 7 (seven) days, including the date on which the service is performed, provided that no calendar month is crossed, in accordance with the Tax Procedure Law.
3. Reservation, Cancellation and Amendment Procedures
Compliance with reservation deadlines is of great importance in order for our transfer operations to be planned and carried out without disruption:
- Standard Days: In order to benefit from the transfer service, the reservation must be made no later than 12 (twelve) hours before the scheduled time.
- Special Days: Due to high demand during religious/national holidays, New Year’s period and official holidays, reservations must be made no later than 48 (forty-eight) hours in advance.
- Cancellation and Refund: If cancellation requests are notified no later than 12 hours before the transfer time, a full refund shall be made. In cancellations made later than the stated period, no refund shall be granted since the vehicle will already have been included in the work schedule. In promotional or discounted sales, no right of cancellation, amendment or refund shall apply.
4. Operational Conditions, Route and Waiting Times
- Vehicle Allocation: Ege VIP Tur may, in cases of operational necessity and upon informing the customer, replace the vehicle with another vehicle of the same segment. If the customer does not accept such replacement, the right to a full refund shall arise; however, no additional compensation may be claimed.
- Route Determination: The route to be followed from the departure point to the destination shall be determined entirely by Ege VIP Tur drivers and operations team, taking into account traffic, road conditions and safety criteria. The passenger shall have no right to request a route change or prolonged waiting at an unscheduled location.
- Agency Delay Option: The transfer vehicle undertakes to be ready at the designated time and location. Delays of up to 15 (fifteen) minutes caused by weather conditions, sudden traffic or similar reasons shall be deemed reasonable. If the delay exceeds 15 minutes, the customer shall not be obliged to wait for the vehicle and may receive a full refund. (The Agency shall not be held liable for delays arising from the refusal to allow the vehicle into a site or residential complex due to site security or collective housing rules.)
- Passenger Waiting Time: The customer must be ready at the transfer point with luggage at the transfer time. The vehicle is obliged to wait for the customer for a maximum of 10 (ten) minutes. If the customer fails to appear within this period (No-show), the vehicle shall have the right to depart and no refund shall be made.
5. Baggage, Pets and Special Requirements
- Baggage Capacity: In Ege VIP Tur transfers, each passenger is entitled to a maximum baggage allowance of 15 kg. Non-standard items such as sacks, crates and commercial boxes shall not be accepted in the vehicle. The Agency shall not be liable for any material or moral damages in the event that undeclared baggage is forgotten, lost or damaged inside or outside the vehicle.
- Prohibited Items: No flammable, combustible, explosive, narcotic, radioactive, malodorous or otherwise legally prohibited substances under the laws of the Republic of Türkiye may be carried in baggage. If such a situation is detected by the driver, the baggage shall not be accepted into the vehicle, the transfer may be cancelled, and law enforcement authorities may be notified.
- Transport of Pets: Requests for pet transportation must be declared at the time of reservation. Pets (provided that they are species whose ownership and transportation are legally permitted) may only be transported in their own private carriers and under the supervision of an adult companion.
- Wheelchair: Guests who require a wheelchair must notify this during the reservation stage in order to ensure allocation of a suitable vehicle.
6. Passenger Responsibilities and Safety Rules
During the transfer, all passengers are required to wear seat belts in accordance with the Highway Traffic Law of the Republic of Türkiye. The guest purchasing the service is obliged to present valid identification documents and the reservation document to the driver or authorized personnel at the time of boarding. Otherwise, the transfer service cannot be carried out. Children under the age of 12 shall not be permitted to travel alone without an accompanying adult.
7. Disclaimer of Liability and Service Disruptions
Ege VIP Tur undertakes to ensure that all vehicles in its fleet undergo periodic maintenance in full, that personal accident insurance policies are maintained, and that the necessary safety equipment is available. However;
- Ege VIP Tur shall not be liable for flight cancellations, delays or operational disruptions arising from airline companies.
- In the event of service disruption due to unforeseen circumstances such as road and weather conditions, vehicle breakdowns, sudden health problems of the passenger or the driver, or law enforcement checks, the Agency’s liability shall be limited solely to the refund of the transfer fee received. The passenger may not claim compensation for missed flight ticket costs or for any other material or moral damages.
- In the event of health problems experienced by the passenger or the pet inside the vehicle, the driver shall be obliged to proceed to the nearest private or public healthcare institution. Ege VIP Tur shall not be held liable for any loss of life or property arising during this process.
8. Force Majeure
In cases of “Force Majeure” arising beyond the control of the parties, such as natural disasters, adverse weather conditions, terrorist incidents, war, strikes, lockouts, public unrest, declaration of a state of emergency, or restrictions imposed by legal authorities, this agreement shall be suspended. The inability to perform the service until such circumstances cease shall not give rise to any right of termination or compensation for either party.
9. Competent Courts and Entry into Force
In the resolution of any disputes arising from the implementation or interpretation of this agreement, the laws and legislation of the Republic of Türkiye (including, without limitation, the Highway Transport Law No. 4925) shall apply, and the Burdur Courts and Enforcement Offices shall have exclusive jurisdiction.
All our guests who purchase the service via virtual POS, bank transfer, EFT or mail order, who complete the reservation process directly, or who use the service through a reservation made on their behalf by third parties, shall be deemed to have read, understood and fully accepted all provisions of this agreement.
